Kumanu Terms of Use

PLEASE READ THESE CUSTOMER TERMS OF USE CAREFULLY BEFORE ACCESSING OR USING THE PURPOSEFUL BY KUMANU WEB AND MOBILE APPLICATION, AND ITS RELATED SERVICES. YOUR ACCESS OR OTHER USE OF THE PURPOSEFUL BY KUMANU WEB AND MOBILE APPLICATION, AND ITS RELATED SERVICES CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THE TERMS OF USE SET FORTH BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS OF USE, YOU MAY NOT ACCESS OR USE THE PURPOSEFUL BY KUMANU WEB AND MOBILE APPLICATION, AND ITS RELATED SERVICES AND SHOULD EXIT IMMEDIATELY.

Kumanu provides the Purposeful by Kumanu web and mobile application and its related services ("Products and Services") subject to your compliance with the Terms of Use ("Terms of Use") set forth below.

Kumanu reserves the right to update and modify the Terms of Use at any time without notice. New features that may be added to the Products and Services shall be subject to the Terms of Use. Should you continue to use the Products and Services after any such modifications have been made, this shall constitute your agreement to such modifications. You may always view the most recent copy of the Terms of Use here: https://www.purposeful.io/terms

Violation of any part of the Terms of Use may result in termination of your account.

Account Terms

1. You must be 13 years or older to use this Service.
2. If you are under the age of legal majority where you live, you represent that you have the consent to accept this agreement from your parent or legal guardian and that your parent or legal guardian consents to this agreement on your behalf. If you are a parent or legal guardian of a user under the age of majority where you live, you are subject to these Terms of Use and responsible for your child's activity on the Products and Services.
3. You must provide a valid email address and, if you are subscribing to certain subscription plans - a valid credit card number, to complete the sign-up process.
4. You are responsible for maintaining the privacy and security of your account. Kumanu will not be held liable for any damage or loss that may result from your failure to protect your login information, including your password. Notify us immediately by email at support@kumanu.com of any unauthorized use of your account or any other breach of security.
5. You may not use the Products and Services for any illegal purpose or to violate any laws in your jurisdiction (including but not limited to copyright laws).
6. Our Products and Services, including the content, data, and features, are owned by Kumanu, Inc. and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the app or use any Kumanu, Inc. logos, trade names or slogans without our consent.
7. You must not undertake any action that would disrupt or interfere with our Products and Services or other users' use and enjoyment of our Products and Services (including the servers or networks to which any part of the website or app is connected), including transmitting or uploading any malicious code, malware, viruses, worms, Trojan horses, or any type of content or code that is destructive or disruptive in any way.
8. You must not attempt to identify any other users of the Products and Services or collect personal information from any other user.
9. You must not use our Products and Services to harm, exploit, or attempt to harm or exploit any other individual.
10. You must not use any type of automated bot, scraper, crawler, spider, scanner, or other device that harvests, copies, indexes, or retrieves any information from our Products and Services. You may not create an account through any such unauthorized means.
11. You must not take any action that would suggest or imply that our Products and Services are associated with you or any other website or entity or attempt to impersonate Kumanu or a Kumanu employee.
12. You must not use our Products in any commercial manner including to solicit business, conduct contests, or engage in unauthorized communication with other users.
13. You must not collect, use, or solicit any passwords or other account credentials from other users of our Products and Services.

Special Notice Regarding Your Safety

At Kumanu, we are focused on helping our users find purpose and meaning in their lives. Sometimes our users are suffering from mental illness, feelings of worthlessness, or substance abuse, among other things. Kumanu provides information to help users find purpose in their lives, but this information is for educational purposes only, may not produce results in every case, and is not designed to help those struggling with suicidal thoughts or thoughts of harm. Although our machine learning algorithms may identify certain words, phrases or concepts associated with depression or suicidal thoughts, it is impossible for Kumanu or our Products and Services to monitor and identify every potential issue a user may face, and although we reserve the right, we have no obligation to actively monitor or report on content submitted by users. We are not health care providers. Kumanu's Products and Services are not a substitute for professional advice, diagnosis, or treatment of any mental disorders. Always seek the advice of a mental health professional or other qualified healthcare provider. Your use of our Products and Services does not create a therapist-patient relationship or any other confidential relationship.

OUR PRODUCTS AND SERVICES DISPLAY THE NATIONAL SUICIDE LIFELINE NUMBER IN SEVERAL PROMINENT LOCATIONS THAT USERS SHOULD USE WHEN FACED WITH SUICIDAL THOUGHTS OR THOUGHTS OF HARM.

Payment and Access

1. A valid credit card may be required to access our Products and Services depending on the plan you subscribe to.
2. We will charge you a subscription fee based on your chosen subscription plan on the first day of the subscription period and the subscription fee is non-refundable except as outlined in the cancellation policy below. There will be no refunds or credits for partial months of service.
3. All fees are exclusive of all taxes or duties imposed by governing authorities. You alone are responsible for payment of all such taxes or duties.
4. Kumanu reserves the right to modify, suspend, or discontinue the Service at any time for any reason.
5. Kumanu shall not be liable to you or to any third party for any suspension or discontinuance of the Products and Services.

Cancellation and Termination

1. You alone are responsible for the proper cancellation of your subscription.
2. You can cancel your Purposeful subscription at any time. If you want to cancel a subscription you have with us, please visit your Settings page in Purposeful and click on "Manage Subscription", or email us at support@kumanu.com. If you created your subscription through Google Play or the Apple App Store, you can also cancel your subscription directly from your Google Play or App Store account settings.
3. Full subscription refunds for Purposeful will be granted for requests received by our billing team within 7 days of the payment. After 7 days, no refunds will be issued.
4. When you cancel a subscription, you cancel only future charges associated with your subscription. Cancellations are effective at the end of the current billing period, and as such, Kumanu does not offer prorated refunds for cancelled subscriptions. All subscriptions are recurring and will automatically renew after the end of each paid subscription period. You will not receive a refund for the current billing cycle as you will continue to have the same access and benefits of your subscription for the remainder of the current billing period.
5. Kumanu is also free to terminate (or suspend access to) your use of your subscription or your account, for any reason in our discretion, including a breach of these Terms of Use. Kumanu has the sole right to decide whether you are in violation of any of the restrictions set forth in these terms. You will not be entitled to a refund in these circumstances.
6. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.
7. Cancellation of your account does not automatically delete your personal information from our Products and Services. Information on how you can request deletion of your personal information can be found in our Privacy Policy.
8. Kumanu may refuse service to anyone for any reason at any time.

Copyright and Ownership

1. Kumanu or its suppliers own the intellectual property rights to any and all protectable components of the Products and Services, including but not limited to the name of the Products and Services, artwork and end-user interface elements contained within the Service, many of the individual features, and the related documentation. You may not copy, modify, adapt, reproduce, distribute, reverse engineer, decompile, or dissemble any aspect of the Service which Kumanu or its suppliers own.
2. All content posted on the Products and Services must comply with U.S. and international copyright law.
3. When you voluntarily submit to our Products and Services user-suggested content such as tips and ideas, you grant us the right and an irrevocable, perpetual, worldwide, royalty-free, fully-paid-up sublicensable and transferable license to use, modify, display, reproduce and distribute the user-suggested content. The explicit intent of user-suggested content is that the content is shared by Kumanu with other users. Note that we only use personal data in ways that conform to our Privacy Policy and our policy is specifically intended to protect your data.

General Conditions

1. Your use of the Service, including any content, information or functionality contained within it, is provided "as is" and "as available" with no representations or warranties of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume total responsibility and risk for your use of our Products and Services.
2. User support is only provided via email at support@kumanu.com. Our business hours are 9am - 5pm ET, Monday through Friday, excluding Kumanu company holidays.
3. You understand that Kumanu uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Products and Services. A listing of these third party suppliers can be found in our Privacy Policy.
4. You agree not to resell, duplicate, reproduce or exploit any part of the Products and Services without the express written permission of Kumanu.
5. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Products and Services customer, Kumanu employee or officer will result in immediate account termination.
6. You may not use the service to transmit any viruses, worms, or malicious content.
7. Kumanu makes no warranties regarding (i) your ability to use the Products and Services, (ii) your satisfaction with the Products and Services, (iii) that the Products and Services will be available at all times, uninterrupted, and error-free (iv), the accuracy of mathematical calculations performed by the Products and Services, and (v) that bugs or errors in the Products and Services will be corrected.
8. Kumanu is neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to your use of the Products and Services. Your sole remedy for dissatisfaction with the Products and Services is to stop using the Products and Services.
9. If any provision of the Terms of Use is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby.
10. The failure of Kumanu to exercise any right provided for herein shall not be deemed a waiver of any right hereunder. The Terms of Use sets forth the entire understanding between you and Kumanu as to the Products and Services and supersedes any prior agreements between you and Kumanu (including, but not limited to, prior versions of the Terms of Use).
